20 years of Blemish free driving Alledged doing 40 mph in a 30mph area.(or first time ever been caught?) and I get a Notice of intended prosecution        What happens now?

Don't know what happens next, but I had one come through a couple of weeks after having sold my car (forms filled in straight away and sent off).  I filled in the notice received, accordingly, and sent it back.  Never heard another thing.  That was just before xmas a couple of years ago, so whoever bought my car had a nice xmas present.  :twisted:

Well my dad got pulled last year, after probably 40 years of safe or at least unnoticed bad driving.........all they did was made him go to a speed seminar. It cost him I think £50 for the seminar and then he had to get B & B too cos the seminar was in the town where he was caught..... dont think he was doing 40 in a 30 though,  think he was clocked at 36.  This also saved him getting any points on his license I believe.

Although this is not an excuse,I assumed the speed was at 40mph, maybe I need to go back onto the road where this 'offence' occured and see if the signage was there to indicate this.

What is the law where points on licence happens?
how many can they give me,is it compulsary that I am given them,or is discretion used?

As I am now an 'alledged criminal' do I go off to court and make my plea,or Do I get a fine through the post along with an endorsment?

the first letter you get is to confirm the driver details etc. you fill that bit in and send it back then in about 2 weeks you will get the fixed penalty notice this has the option on it of going to court if you want or just pay the fixed charge. I did the court option on mine and i still lost but they only did me the 3 points and £60. and that was my third in about 9 months after 20 years of not even a parking ticket  :?

If you wish to challenge the speeding then do not sign the NIP they sent you, if you sign that its an admission of guilt!  As suggested go to the pepipoo site (cant remember spelling) and ask on the forums there.  Also be aware that not telling them who the driver is is also an offence (i can vouch for this cos i got done for it and have 3 points and £450 fine for not telling them who was driving.

speeding is an offence but not a criminal offence.
a NIP or notice of intended prosecution does not mean that you WILL be prosecuted, they are informing you that they MAY do.
remember your speedo can be upto 10% out either way as allowed by law. most convictions are based on ; taking the speed limit, so 30mph plus 10% plus 2mph. so that gives you 35mph! anything over and its speeding.
NOT signing the NIP can be classed as obstruct police, a criminal offence  :shock:
not all built up and lit areas are 30mph. take a look at the road where it happened, is it clearly marked 30mph, if not are there repeater signs, was it a static or mobile camera, are there signs warning of speed cameras etc etc .

speed seminars are new to me ive never heard of em .. birmingham is quite well known for hitting the motorist for speeding and parking fines  :x

It is a very informative site and will need a few visits to absorb the wealth of information on there,Thank you for pointing me in that direction.

I know the simple and easiest solution is to pay up & shut up,because thats the british thing to do,accept the consequences and be mindful never to repeat again.

But if there is a small chance,It is my right to go for it and hope that I get the result I want.

speed seminar is now called a speed awareness course.you pay £95 and spend a full day listening to some council worker lecture you on how excess speed kills.you watch a video of people being run over and other shock tactics.then after the free sarnies and pot of tea they take you out with a driving instructer.one peson drives and then others comment on you speed and how your a bad driver.

you must show an improvement in your attitude and driving style.they then give you a cert that says you'r aggressive,impatiant etc and let you go home.no points on liecence,no £60 fine.

i asked to do the coarse as i didn't fancy the increase of insurance.you can only do 1 coarse every 3years.tip for general driving only do 9mph over the limit as 10+ does make a difference to their attitude!

oh yeah doing a big dirty burn out on leaving the speed awareness coarse doesn't go down too well,but does make you  feel better!

yes ask for the camra calibration cerfiacated also ask for the speedo calabration certificte if it was a mobile or handheld camera it must be checked before they use it by driving a police car through it to check the speed camera this has to be done with a police car that has had a speedo calibrated. found that one out after i had got done doh. wish i had know that one before as they dont think the public know that one. so most forces dont bother checking the camera with a police before and after use.

a work collegue of mine got caught doing 40ish in a 30 on his motorbike on the back wheel and had the option of getting some points on his licence and have to pay £100 or pay £60, no point on his licence (he knew he was in the wrong so he paid the £60 and went on the course) and go on a course to teach him how to (speed correctly :lol:) drive / ride safely at the speed limits it was a 2 day course.

By the Royal Mail its now 30mph. Starts at 30 just after the underpass Aston six ways. There's also a traffic light camera just before the Barton Arms.

Newton Road and the Birmingham road into Walsall is plagued with cameras and they've also lowered the speed limit to catch people out :roll:

Trouble is if it was only recently dropped to 30 it may be overlooked but I think this has been 30 for quite some time now.

i have a book on my pc that has everthing you need to know about  speed cameras both hand held and fixed it is full of good info and lots of get out of this one. it makes good reading and has come in handy when i went through a red light in icy conditions. anyone want a copy pm me and i will send it to you. Depends on wether you want a £60 fine and three points.  

http://forums.pepipoo.com/index.php?showtopic=2846 tells you what to write on the form if you want to have a go at getting away with it.  It's up to you whether you suck it up and pay the fine (the easiest way out if you have an otherwise clean licence) or put up a bit of a fight.

i got done on the A1 in my tranny van doing 70mph, because the speed limit in a big van is 60mph. i didnt know this :x

so for anyone out there that drive a panel van (transit or other type) or upto 7.5tonnes wagon (catagory is light goods upto 7500kg)
your speed limits are

single carageway 50mph
duel carrageway (like A1) 60mph
motorways 70mph.

so now i drive at the speed limit, all cars backed up behind me flashing there lights, but hay what can you do

I have heard that if you share the vehicle with someone else you can say you aren't sure who would have been driving the vehicle and couldn't be sure you wouldn't perjure yourself in saying who you thought was driving.

Apparently this was used by a serving police officer but may be urban myth.

Not quite. Dual carriageway for HGVs (as in over 7.5T) have a 50 mph limit. Motorways have a 60 mph legal limit, but with the limiter, some of us are restricted to 53, unless going downhill heavily loaded :D

As for the Transit van, it depends on the GVW. If it is under 2 Tonnes, normal speed limits apply. If over, it goes into the Goods Vehicles under 7.5T category.
