Bigot!
« on: July 05, 2006, 18:49:03 »
Now we all know that most of the press and a lot of other groups of people discriminate against us when it comes to driving on green lanes but I have discovered a new breed of bigot recently.

I recently started a new job and have been settling in nicely until the other day when I used my modified Suzuki Vitara to go to work.

Since then I seem to have been getting all the lousy unpleasant jobs sent my way. Today I found out from a close colleague that the Manager of the company is a member of the Ramblers Association!.

Somehow I doubt that it is a coincidence that I am getting all the rubbish jobs passed my way so soon after parking the Vitara (with large GLASS stickers on) in the company car park.

What a small minded bigot this guy must be

Sue him for Discrimination... That'd teach them. Or try to get round the legal way, would be fun to watch a rambler squirm.

Look into work related discrimination laws. But you need evidence & preferably a colleagues statement.

Pretty sure theres a solicitor on here, cant remember who though.

Well if you leave that would be constructive dismissal.

Personally I'd have a HOOOOOOGE sticker like Julie's made up, "I slow down for horses, I ACCELERATE for ramblers" and see how long it takes to get the sack.

be careful as you need to prove it to HR

if HR believe your story then i would suggest you ask them to find out if this guy has something against you since you own a 4x4.

also is the mgr sending you the jobs directly or not?

what is your role?

thing is since you are a newbie in the company you dont know who is who...

but this is classed as bullying in my view and not to be tolerated.

also what is a pithy job?

As mentioned, this is all about evidence.   You say that you "seem to be getting" all the lousy jobs...  before you can do anything you need to be able to *prove* that there are definably worse jobs and that you are getting them in greater proportion to anyone else.

You then need to be able to prove that he is the one solely responsible for assigning jobs, and then (the hardest part) you need to be able to produce some kind of evidence that he is doing so through some prejudice directed at  you.

I don't mean to be negative, but you need to be able to demonstrate that the jobs he is giving you don't fall within your normal remit and that you are being singled out for personal reasons before you could proceed with any sort of action.

Might be worth getting to know him a bit better and see what makes him tick ;-)

What do you do for a living? How big is the company? does he look hard? (just kidding , honest)
I often find the direct approach works. If he really has singled you out say so . By the sounds of it he cant give you any worse jobs!

Beware. If you haven't been there a year there's not a lot you can do about it. He can get rid of you without being liable for Unfair Dismissal and if you leave you won't be able to claim Constructive Dismissal as it's based around the same sort of laws. I'm not a solicitor, I can't quote chapter and verse as there maybe a law that supposedly covers you. But in the real world where the bad guys win sometimes, you're likely to just get the boot if you make any waves.

Been there and got the T-shirt.

Best thing is to keep doing what you're doing. Go to work and work hard. Greenlane responsibly. Be happy!

ERA 1996 s108 - Qualifying period of employment
(1) Section 94 does not apply to the dismissal of an employee unless he has been continuously employed for a period of not less than one year ending with the effective date of termination.

Unfair dismissal -
The statutory concept of unfair dismissal was first introduced in nthe Industrial Relations Act 1971. It is now contained in Part X ERA 1996. Section 94(1) ERA 1996 contains a statement of the right, namely that employees have the right not to be unfairly dismissed by their employer. In looking at the question of whether a dismissal is unfair, a number of stages need to be gonr through. These are concerned with, first, establishing the individual's eligibility for protection; secondly, showing that a dismissal has taken place and determining the effective date of termination; thirdly, looking at the reasons for the dismissal; and, lastly, the question of reasonableness.

Well, decided to take the bull by the horns yesterday and confront him about it as politely as possible. I took along one of the GLASS leaflets that explains that we are not a set of hoodlems and that we do care for and respect the countryside.

Turns out he has had some dealings with a set of nutters who covered him & his friends in mud once whilst out walking. I explained that these are the sort of people that we try to diss-associate from and suggested that if he had any further problems with vehicles behaving badly whilst out walking he should inform the police or contact me directly if the vehicles have any GLASS or Mud-Club badges on.

Strange how I seem to have a normal workload with fairly straight forward jobs this morning!. :?

Thanks for all the support.

Mark.

Glad you got that sorted, try to concert him. It just goes to show how easy it is to pidgeon hole people.
I spent most of my late teens and early twenties with long hair tight jeans and a Slayer t-shirt on. People would do anything to avoid me. To this day i have never heard of any violence in a rock club , small minded muppets- theres' just no educating pork.
