The only thing I know about Tom's farm is that everyone seems to post the same query on different forums every so often but no one ever seems to give a answer with a location :(

More like a case of someone in their seventies no longer able to cope with running a farm and still farming in the same ways when he started some 50+ years ago. He makes more money from the off-roading anyway so could stop but more likely down to the fact that he's been doing it all his life and doesn't want someone telling him when to stop.

Not condoning mis-treatment of livestock but I'm also not one to wade in with aspersions not knowing all the facts either.

Cheers

Copied this out of a news report...........

Farmer jailed for cruelty

Llandrindod magistrates handed out a jail sentence and dire warnings this week to a Rhayader farming couple banned for life from keeping sheep, cattle and pigs after causing unnecessary suffering to sheep on their farm.

Farmer Thomas Steven John Breese, 64, of Cwmderw, Pantydwr, was jailed for 11 weeks. His wife Elizabeth, 63, was told: “While he was in prison you will be deemed to have sole responsibility. If you are brought before the court again you can guess what the consequences will be.”

At an earlier hearing at Merthyr Tydfil Crown Court, the Breeses lost an appeal against their conviction and were given seven days to clear all livestock off their land.

The court was told sheep at the farm had to be destroyed by vets because they were emaciated, anaemic, had lice and were too weak to stand.

The court was told both Mr and Mrs Breese have previously been subject to banning orders. Mr Breese was banned from keeping bovine animals and sheep for five years in 2001, and Mrs Breese was banned from having custody of bovine animals for five years in 2004.

Judge John Curran dismissed the appeal on four charges relating to four specific animals, and ordered the couple to pay £5,500 costs at £500 month.

At Llandrindod this week, Mr Breese was ordered to continue to pay the £250-a-month half share of that. Mrs Breese was ordered to continue to pay her half share, plus an additional £400 costs imposed by Llandrindod magistrates, still at £250 a month. Her existing community order for unpaid work was revoked, and a new one of 200 hours imposed.

Mr Nigel Vaughan, prosecuting, said the judge at Merthyr gave the Breeses 14 days to comply with the order to get all livestock off their land, and said that if that were not done a custodial sentence should be considered.

“But when officers visited the farm on July 24, 21 days after the 14-day order was imposed, Mr and Mrs Breese still had the same herd there, in direct contravention of the ban,” he said.

“They have now admitted they are in breach of the court order. I ask the magistrates to consider the seriousness of this matter in light of the Crown Court judge’s statement.”

He said the Breeses had sold some of the sheep, but officers found other sheep still on the farm. “Mr Breese says the ownership of these sheep has been transferred to a farmer from Welshpool who is renting the grass keep, but there is no record of this transfer,” said Mr Vaughan.

He said the Breeses had a number of previous convictions and an assortment of orders had been made against them, but never before had a complete ban been imposed on the care, control or ownership of animals.

The Breeses asked at the Llandrindod hearing to have taken into consideration the matter of a ram found with its horn growing into its eye, damaging the eye and considered by a vet to be suffering distress. It had to be destroyed.

Mike Davies, defending, said the couple had been farming for well over 50 years. They were perhaps not in touch with modern farming methods.

“There has admittedly been a reluctance of Mr Breese’s part to accept the rulings but that doesn’t mean he has no remorse or that he doesn’t intend to abide by the rulings.”

I notice they were already banned when they were caught again . Out of touch is one thing , but I think an ounce of common sense would tell anyone that these animals were in no fit state !
If the offroad site was as good as claimed - he should have concentrated on that . I don't think age is much of an excuse . I'm sure this "poor" farmer could have afforded a livestock keeper if he had cared to ?

I am sorry, I dont care how old, poor, out of touch etc, anyone can see when an animal is in pain or mistreated. If they dont do anything about it then they deserve all they get.

Having been there twice I do not consider that this farmer is in anyway financially poor, apart from in the common-sense department, the off-roading is great terrain, but there are no health and safety measures in place, nor is there any regard for the present or future care of the land. If some management plan were in place, parts of the land able to repair and regenerate after the damage of vehicles happened this place could be incredible and an absolute gold-mine.

One issue here...  there are restrictions on how often you can use land for non-agricultural purposes if it is classified as agricultural.  For the farmer to concentrate on the off-road "business", there is a good possibility he would have to apply for planning permission for a change of use.

The above is meant for information... I'm not condoning poor treatment of animals...  for that there is no excuse, especially if there is a history of it and court orders are in place.

hi guys
in no way shape or form do i agree with wot tommy has done but as said previously he's doing his time and if mrs breeze is sorting the livestock issue then all good..
but IMHO instead of boycoting the site why not offer to help get it sorted??
its plain to see that they cant do it alone ..
this is all up in the air at present as the locals have decided to try and get it closed down for good
but on the other hand im sure they will miss the offroading trade that goes through rhayder every weekend???

just my 10 pence worth agree or dis-agree everyone has there opinion

Now where do you get that one from? As far as I know that has not been raised, and as for immediate neighbours, there aren't any.

The questions that have to be asked, are,
Do they have planning permission to change from agricultural use to commercial?
Do they have Public Liability insurance , as required by ALL businesses, for the use they intend?

And I doubt that Rhayader would notice much loss of trade as most people appear to camp on site.

I hope the locals succeed in closing the place down, people like that deserve to be living in a hovel not knowing where the next meal is coming from, just like the animals that they neglected. Karma is a wonderful thing!

I went there once and it's impressive. I got the impression Tommy  did live in a hovel and quite probably did live very hand to mouth.

I doubt that he mistreated his animals with any malice just incompetence which is no excuse whatsoever.

I hope it gets sorted, he can sort out the animals and the site can be used.

I heard a rumour that the sheep were wearing bobble hats at the time and that the authorities were not sure if they were of the human variety or  not.

They plumped for the animals though as they felt they might not get a conviction for cruelty to ramblers in a welsh farming community.
