With the van not having his brakes on has probably saved you alot of injuries as he was in theory a soft impact instead of a solid object, you hit an object that took the force and moved away again.Glad your well though.
Just a bummer , as because you were the last car its automatically your fault!
If he'd had his handbrake on, wouldn't that mean his brake lights weren't lit? Sounds daft, but I've never been sure whether brake lights are connected to the handbrake too.
