Are there any legal eagles out there who could help me out with a dispute with a car wash company please.

I took the Disco through a car wash in Warwick last Saturday which ripped off my roof light bar.

Do I have any legal recourse against them? I spoke to their customer services this morning who said it was down to the operator to sort out, so I spoke to him and he said that there must have been something wrong with the installation or manufacture of the bar for the roller to break it. Is this just them trying to get out of paying up, or will that stand up as an excuse?

Any help or advice would be greatly appreciated.

I was always under the impression that, that was the risk you took with car washes....  As iv seen boards infront of most that say they take no responsibility etc etc etc

bit like if u go to the safari park and a monkey rips ya wiper off!  :?  Dunno though

Speak with Citizens Advice or local Trading Standards. They should be able to come of with something. There should be something under consumer rights.

A buffalo sat on my mates front wing (scratching its bum I think ! ) at Blair Drummond safari park - thats one insurance claim I would like to see !  :lol:

I'd take some pics if there are no warning notices then when asked what i was doing i would say "my solicitor has advised my to take photo's to show there are no warning signs because he says we have a good case to get compensation due to the damage caused to my vehicle and you refusing to pay for the repairs" see if that shakes em up!

Send them an estimate for all the damage, they are liable for any faulty equipment, you paid for a service that was not done properly, ask the Manager for there insurer's name & address, get his full name as well & tell him you have spoken to the legal team with your insurance company & this is what they have asked for, if you need a fully computerised assessment let me know you details via pm,

As already stated get some photos,

You will find that the equipment must be fit for the purpose.
The operator took your cash so this is an admission that he thinks its OK for you to use the wash.
Its standard policy to fob you off.
Remember it will come in handy even if you never use it
