Are rear seat belts needed?

My car (fiat cinquecento) is in for the mot tomorrow and i have been falling out with my old man about whether it will pass or not due to the fact i have taken out the rear seat and seat belts. I was under the impression that if they are there they need to be in good condition but if the rear seats are out then they arent needed.

The law states that if seats are fitted they need to have seatbelts, but if there are no seats then no seatbelts are required.  I had a bother with me first 109 a few years ago where the passenger side rear seatbelt didnt work (it was a station wagon).  I took out the offending seat and it passed the mot.

 I would also agree that if no seats AND seat belts are in place its ok

Has your V5 been altered to show that you have removed seats?

This could be the point the MOT guy is getting hung up on, if it is suppose to be there and not present at test.

 :undecided: MOT examiners only test what they are presented with so the V5 and contents should make no difference.

If the vehicle doesn't fit what is listed on the v5 database, then it is an immidiate fail.

Gav, take to to birchwood motors matey, I've had this a few times, however make sure if you do intend to put them back in you get new belts  [-X

Yes this is starting to be an issue with some MOTs as it's all computerised.  The rule is typically if it's not fitted it can't be tested but then if the details on the system don't match what's presented for test they can/should refuse to test it.

this is a load of S*** yes it is linked but the MOT tester wont check the database as they have to do more work then :doh:

If there are no seats,you dont need seatbelts,its common sense, how are you gonna put the seat belt on when theres no seat to sit in?

thought that it was based on HOW IT WAS MANUFACTURED??
Ie if it was a 5 seater - then it has to have 5 belts.....BUT we have car seats fitted - and they have always been N/A for rear belts as they cannot remove the car seat to test them..

I took my Dads vw Sharan people mover in for an MOT for him once and he had removed the rear 2 seats to fit a great dane in the back. The seat belts were still there and the MOTguy said no seat = no fail. If it isnt there he cant test it.

I actually had the back seat of my rover filled up with caravan tat once, and I couldnt even see the seat! They didnt test the seat belt then!

If you diddnt already know if are building a racer and stick 4 point belts in that you intend to use on the road then the belts need to have the red push button on to technically pass the MOT/SVA, I cant rememberifanyofthese will be up to spec for whatever racing you are doine (FIA cert etc)  That said my Elise has 3 inch sparco FIA spec belts with a center quick release and its passed the last few mot ok, so do many other people, however the odd one gets picked up on by a knowledgeable/pedantic tester.

The reason is that standard belt releases aid emergency services when looking to get you out in a hurry/smoke/dark etc. Not sure if anyone who works as such thinks this is problem for the odd car?

they will fail it as they are fitted so they have to test it we had one the other day but the MOT tester said "tough remove it"

Am I right in thinking that If a car was made before 1984, that rear seatbelts are not mandatory. I only say it as some years ago I had a 1980 capri with no belts in the back.
