ive just been to cornwall on hols and before i left i left my terrano for mot at the local garage and on my return AFTER  id paid him i found out the car had been backed into , cracking the reg plate and creasing the bonnet i can actually see the metal under the crease , it looks a proper mess :angry: :angry: :angry:
the guy said at the garage that it was on private property and take it through my insurance so it will cost ME  £150 before i stare with my exess
why shoud i pay , he says hes not insured as it is private property and advised me to put a sticker over the damage :angry: :angry: :angry:
its a shame id already paid him

Get onto your insurers and ask for legal advice. I'm no expert but I suspect that he has a "Duty of Care". If HE put it in a public place, it's his problem. If you put it in a public place however... well... I think you might have some difficulty.

Either way, first stop should be legal advice. Most policies include this as part the deal.

all MOT & repair garages have insurance to cover Accidents like this it is Liability Insurance, if he says he doesnt then he should not be running the business from there and get in contact with VOSA and they will shut him down,

I'd give Trading Standards and the Citizens Advice Bureau a call and see what they say. It sounds a bit moody to me. :?

ive contacted the trading standards and they say he has to care for the car in his care and they must pay for any damages caused
but i may have to prove that it was done there , how can i do that when i was 400 miles away and its his word against mine what a crap system
i have taken there advice and sent him a formal letter to do the repairs , ill see where that takes me :(

Would it have passed with a cracked plate ?
Surely if it was cracked and therefore would not have passed the MOT  (if thats the case) then that proves that it wasn't damaged when you left it with him ?
