Hi all how can i legally claim a vehicle thats been abandoned for the last 3 years ,my friend has just bought a property which was a repossesion ,on the drive there is a w plate saab ,which 3 years ago the old owner parked it up and has not been since ,my friend wants this car gone and im happy to take it as its in very good condition ,but i want to do it all above board ,any help or suggestions greatfully accepted

Was the car listed as part of the house purchase may have been on the list so the new house owner could say he "owned the car" ????

Send off for a new log book for yourself, if there is no objection from the previous owner your should be ok, DVLA normally send a letter to the current owner, if they recieve no reply you will recieve a log book

If they do recieve a query from the old owner tell them to get it shifted


I imagine there is a more legalistic method but this could be a basic route to take

his solicitor congratulated him on inheriting the car ,but we wanna do it legally ,this car is mint and is fully loaded ,it beggers belief that someone has just walked away from his home and belongings ,after doing a hpi check there is nothing untoward regarding the car ,if dvla write to the old owner then no reply will be given coz my mates bought the place lol..i,ve been told the vehicle was driveable before it was parked up

Just scrap it and take the money,if the owner appears which i would say is highly unlikely present them with a bill for storage.

if it has been stood for so long it will have no MOT or TAX drag it out in to the road and report it as having an out of date tax disc and they will be round clamp and remove it with in a few hours

My mate had a P6 in his unit that a guy had brought in for restoration, then run short of funds.  He applied for a log book and sold it to another enthusiast.  he also worked out storage for the 5 or 6 years he's had it, £36,000 :shock:

You might find in this case that it's registered at the address anyway :-k

But it is an offence to scrap a car without a log book, not that many scrap men care.

Im going through a similar thing with a Karmann Ghia, 5 years ago it was left at a friend of mines garage for some repair work, shortly after this the owner went into a mental hospital, leaving no instructions for the car. 2 years ago my frind moved from his premises and pretty much jacked the job in. He was paying to have the Karmann kept in secure storage but it has now run up a bit of a bill that he cant afford to pay, and the car has been moved into the firms car park. So the other day i sent off a log book application, and if i get a log book then i am buying the car for the sum of the storage bill.

Just hoping that the owner isnt a psycho killer or awt!

Don't forget that the holder of the "log book" is not the owner ....Just the registered keeper.....

the owner is the one with the receipt ;)

If you apply and get the v5, you are not the owner just the registered keeper, you need to send following form and state it is on private land and send owner letter asking for storage costs etc or to give up ownership give them set period to reply.

You should state that you require the information to have the vehicle removed etc,not because you want to buy it, you may be driving it and the original owner can report it stolen !!!!.

yeah but the previous owner will have to prove that he is in fact still the owner of the vehicle. seeing as though you would have a log book etc, it will be a lot harder for them to prove they actually own the car. you have to do nothing except produce the v5 when asked.

Cool, a proper answer.  The limit of my knowledge I guess is that the log book has no record of the legal owner and AFAIK the only other record would be if the car were financed, the law protects the lender and allows them to seize a car that has outstanding finance (not news to many of us I know).

If you are possesion of the car, the logbook, insurance MOT and tax for it, well I agree it would be hard to argue it isn't yours :-k

BVut if you have tried to contact the previous owner that's another base covered, even if you receive no reply.

If it's in good condition it's well worth saving - the pre-GM takeover 9-3s are very well regarded amongst Saab enthusiasts.

Allegedly quality went down after the takeover. Well my Dad runs a 2006 9-3 TiD as a company car and it is far, far better screwed together than the Renault he had before. If the older ones are better than this then I'd be biting his hand off to claim it!

I thought that vehicles that weren't taxed had to be SORN'd and those that weren't were chased by DVLA. Did this happen or is it just a myth?

its a 2000 model w reg ,the 1'8 turbo which is the vectra i'm lead to believe i did a hpi check and all is clear .

No myth, happens all the time, just some manage to get away with it!

I got got with my series 2a, I had it on sorn but the reminder didn't come in for it so I forgot to renew! Tried to challenge but was informed that they do not HAVE to provide a reminder!

Yup, friend of mine was scrapping a couple of vehicles left on his land (farmer), one of them had not had a SORN reminder from the DVLA, and he was screwed by the DVLA for £40.

This is a licence to print money, the vehicle wasn't used for well over 12 months and parked on private land, and taken away by a scrap dealer on the back of a lorry, yet they still wanted money insisting that the owner is responsible and they don't have to provide notice that the SORN is running out.

Anyone with a collection of old cars should be wary.
