well i now have lost faith in this countries ability to get anything right...
the reason i say this?
i got a letter through the post 4 weeks ago saying i owed the courts £145 for a fine. no other info.
i had no idea what it was about so contacted the fines department. i was told after they did some digging it was for a bike that i had sold over 3 years ago. the dvla say that i didnt notify them by sending in the log book that i had sold it.
the woman at the fines department was very helpful to be honest. she did some more digging for me and found out that i had already had a court date etc but not turned up. ( no s@it )
i explained that i knew nothing about any of this at all. so after more digging she found out that for 3 years they were sending court letters to the wrong address...
so i had to write to the correct department to get explain what had happened and get it all sorted.....
i honestly thought when i wrote in that they would see scence and dump this stupid case...
well no. it seems they are going the whole way. i now have a letter saying i need to go to court on the 16th june to get the case opened again. once its opened i need to go to court again on the 18th sept to plead my case.as this was over 3 years ago i cannot find the letter the dvla sent to say they had recieved the log book.....who keeps them for more than 3 years??
i am completly gutted as this is all going to happen when i am getting married. i will be awy on my honeymoon until 3 days before the new court date....
i cant be dealing with this while im supposed to be away on the best holiday of my life so it looks like im going to have to pay up.
i am so annoyed with the courts and the systems in place.... rule britania ( land of money making )
keep all those dvla letters guys n girls.... they may want some money from you

I don't suppose you have the receipt for the sale of the bike? Or the name and address of the person you sold it to? Like the DVLA letter, it's not something you would expect to have to keep for 3 years.

beleive it or not we had a clear out of all old paper work 6 months ago or so.....i tend to keep things like this for a while and then get rid....we only have a small house so cant keep all the paperwork for years :oops: :oops: :oops:
although that would of been 2.5 years we had kept it for....inc the reciept from the buyer which all went in the schredder :? :?

I have had this before, I had over 100 tickets outstanding for a Rover 3500sdi I had sold on, the new owner was in dispute over double yellow lines outside his house and I found out I was still the registered keeper for some strange reason, went to court and gave evidence and it was thrown out, warrant issued for new owner and he was caught and went away for a few weeks to clear his debt when they caught him, don't pay go and speak to them, it worked out for me

If it's three years he must have taxed it at least twice, probably three times.
If you didn't get the renewal reminders then DVLA must have a different address on file?

it says its been taxed and its not liable till next year ....
i think they are trying to have one over on me to be honest.... very unsure what to do now as we are approaching our wedding and can really do without any of this..... :oops: :oops: :oops:

I would go to the court, as you cant tax a car on a green slip more than once now, as they stamp them, so therefore they would have had to issue a V5c in the owners name!

" if they have taxed it previousely then it had to be insured, and there has to be a trail to follow.
Its their problem and they just take the easy way out, I,m sure there must be a way they can check their own databases for insurance addresses. Traffic police seem to be able to tell you everything about your policy so there must be an address available.

Unfortunately, the person insured to drive the car, or even the 'owner' does not mean they are the 'registered keeper'. And it is the registered keeper that is liable for unpaid fines, etc.
However, if you have genuinely sent the V5 away when it was sold, you should be OK in fighting your case in court. Assuming there is evidence of the new owner using the car (insurance, tax, etc) they would normally assume they should also be the registered keeper.

i have decided that i will make a court apearence on the 16th of this month to have the case reopened.
the main reason being that even if i am found guilty the fine should be alot lower than £145. the reason i say this is the dvla must of written to the wrong address as well as the courts to notify me in the 1st place that i had done something wrong. ( not that i have ).
so the worst case that i can see is i will have to pay a lower fine as it would of been lower before any court action. the dvla have been incompetent all the way though this so i cant see a judge holding any weight in their ability to get anything right....
any thoughts......
i do appretiate all advice given so far :clap:

Are you in the AA or RAC or something ? They usually have a legal department you can use for free that may be able to advise you.
