Seriously, there seems to be a lot of this "reporting proposals as though they're about to be enacted" about. After some rummaging in the article you find that this is actually the demands of a pro-cycling activist in a quango, who doesn't actually have any power to change the law. He can rant and rave at those who do, but they're under no obligation to take any notice.
Oddly enough (given how much the Wail hates the EU and Human Rights), there may be provision in the Human Rights Act to challenge any attempt to enact such a law on the grounds that it would be incompatible with the historic right to be presumed innocent until proven guilty. I agree that it's an idiotic proposal for that reason. There should be no blame attached to any party involved in a collision until a proper investigation has been carried out.
