prob with work need advice

Hi lads dont know if you have read it but i was layed of 2nd week of last month as i posted
now as there was no warning i went and got some legal advice now both the solicitor and acas said that he must pay the week that i worked 3days holiday 2 weeks money in lieu and 2 weeks redundancy
and i was to put this in a letter ans send it to him also as he did not lay me off followering the right way and after letting me that he was doing it as of a lack of work he now has in employ some one to do my job i have a case of unfair dismissal
so today when i checked my money it was well short and i rang him to ask why he said he was not paying me redundancy or notice because he said in his words that i should think this through as he has issues with me and he has had stuff gone from his yard and fuel and if i want to pus it then good as he has proof and i will get a criminal rec'd and the he put the phone down so now i dont know what to do as i aint done anything so any advice or help please !

ps sorry for the spelling im a Little wound up at the mo.

I would of thought that if he had anything on you he would have reported you by now, if you have done no wrong don't be bullied into shutting up, seek legal advice from citizens advice etc, good luck

How long have you worked there?

Under a year and you've not got a leg to stand on,

Over 2 and you should be entitled to full minimum redundancy (weeks pay for every year tax free upto 30K). Going by what legal advice you've had you've worked there over 4 years - 2 weeks money in leu plus 2 weeks redundancy)


If you've been under a year (there's been a change recently to move the 2 years to 1 year but I don't know the specifics) then he can show you the door and you keep on walking.

if you have nothing to worry about and he is bluffing......... just call his bluff and pursue your claim mate. as has already been said, dont be bullied

After one year you are entitled to redundancy (one week per year worked) plus any holidays owed, plus the notice required under your ciontract (you may or may not be required to work the notice period - his choice).  I know, as I was made redundant last year after just over a year.

He must (should!) have given you a written notice of termination.  If this states redundancy, he has to pay it!  If he refuses to pay, you will win a court case.   If it gives another reason, (eg theft, & you are innocent) then you can go for unfair dismissal - he would need to prove his claim.

Hi lads i worked there for 2 and a half years and when i went to get addvice thats what i was told he should pay
its only been scince i said i would take him for unfair dissmissal that he is not paying the notice and reduancy he said what he paid was what i worked and my holiday and that was it   it was then he said about the rest of it
i wet in on a monday morning and he said there was no work and he was laying me off there and then !
