I have just got a secondhand laptop and want to install XP onto it

Do i just upgrade it from the XP disk??

I would be inclined to format your hard drive and go for a clean install.  You don't know what has been done to the existing OS.

When i looked at it it had xp on it but he done a wipe clean and put 98 on it

Not bessed pleased with him!!

You cant blame him giving it a clean wipe as he may have had work stuff on there, but if you agreed to buy it with XP then he should have at least reinstalled that, unless he has a fully legit version with one licence and wants to keep it for his own use.  Should have told you though.

Do you have XP yourself?

As usual i wasnt listenning he did say xp was going to be removed

I take it that It would be best to format the HDD and set the bios to run from the DVD and shove the XP disk in there???

also make sure you have the driver disk for the laptop cos 9 times out of ten windoz does not put them in on a laptop......so a trip to the laptops web sight is a must.......
when laptops are shipped out most of them have a partion on the hard drive where such thinks are keeped but some people tend to "FDISK" the whole hard drive and all is then lost.......
