Ordered a set of 35" BFG muds off the internet......phoned customer service today to get estimated delivery date only to be told there is only x1 tyre in stock....he then went on to say...."but thats not a problem sir, we will send you an alternative set", hold on i said....they must be 35" and mud terrain tyres......The guy replied..."oh....are you sure you wouldnt prefer some smaller???...I said no. He then went on to tell me to call back on Friday afternoon and if they are not in stock then.....they will (offer me an alternative).
Are my rights the same as buying from a shop, or are internet rules different :?: I dont want an alternative unless they are 35" Simex Trekker.

Theres is something called distance selling law, (cant remember proper name ) You have 7-10 days in which to change your mind, and if you paid by credit card you can claim the mony back from them.

You can also refuse delivery if they are not what you ordered, that way you will not have to pay return carriage.

New distance selling laws in the UK
Under the new distance selling regulations you are entitled to cancel this contract with the supplier within 7 working days after receipt of goods and receive a full refund. This law assumes that the goods have not been used and are in pristine condition.
So, as they have not delivered them, tell them you wish to cancel under the distance selling laws and wish a full refund.

Even if they have delivered them you can still cancel under distance selling, they are in breach of your contract anyway if they are supplying something different.
I used to do consumer law work and worked closely with my local trading standards company.

If they havent got them on Friday I will ask for a refund under the above mentioned laws, then go to a more well-known company who wont (hopefully) mess about.

Who is this company if you dont mind me asking? They shouldnt have taken your order if they had no intention of fulfilling the contract...and should be avoided.

Please remember that MC avoids public complaints about particular companies - it could cause the Admin guys all sorts of trouble.
A PM may be better to pass on this info

All who ask for one will get a PM stating tyre web site, saying that...the guy was foriegn (but spoke good english) and perhaps he was just trying to be helpful in offering me an instant alternative, i'll let you all know the outcome. :wink:

If he does want to offer you an alternative may be worth asking what he'll give you for free due to hassle and dissapointment of not getting what you originaly wanted.
Can you PM me the company details as well as would be intrested to know who it was.

Unfortunatley this kind of thing happens a lot when companies start trading on the internet. you get the adverts but they don't reflect the actual stocks.
A number of times this happened to me and in some cases quite important and substantial orders, (for me, anyway), have been held up by some small item being out of stock.
Unless you ring them first to check stock levels then you could end up being dissapointed and/ or inconvenienced.

Well guys/gals.........Good News :D :D , they agreed to cancel my order and ive just placed an order with "Devon4x4" at a substantial ££'s less than the original company i was dealing with :D .
Plus at Devon4x4 you get a very polite young lady to speak to instead of a foriegner who's quite sharp.
