Post by: the loon on February 17, 2007, 21:10:24
Friend of mines just been given 2 parking tickets over the weekend  while parked her car in a suposed "controled area".
She's said thers no sinage or other indication that theres any restriction on parking and had actualy been parked in the same place fo a week but has had two tickets placed today - 1 from 8am ish and one from 4pm ish.
I wont mention the name of the people who have ticketed her but they have a lot of car parks nationaly up and down the UK <ahem>

any one got any idea's about fighting the tickets as it seems strange that (1) theres no signs to say restriced parking etc (2) that she been there all week and no tickets

any help welcome :D

Contact the local council and find out if any parking restriction exist in the area were she parked.
Get back there asap and take photos of the area to proove there are no restricted parking signs incase they suddenly appear!

Record the times over the last week that she has been parked in this area.

Have a look on this site and see if there is anything that's of use: http://www.parking-appeals.gov.uk/welcomeEN.asp

Check with the councli that they have permission to enforce parking and that there is planning permission for it.  A local country park has a couoncil-run pay and display, my mate works there and I got p****ed off paying when I was visiting a member of staff effectively (we have this trading-favours sort of network where we help each other out) but he told me as the council never sought permission (from itself :? ) to make it a pay and display it cannot be enforced.  That's laughable.

IIRC to enforce a parking ticket they have to prove that you knowingly dissobeyed a parking restriction, shame it will cost you about £300 an hour to take it to court.

Citizens advice bureau and trading standards.
From what I recall, if there are no signs up, it can't be enforced. Thats the reason why, whenever tickets are issued by Police/Traffic wardens, they have to put on the ticket the condition of the lines, location of vehicle in relation to signs/lines and also the proximity of the signs to the vehicle.
