Title: sexual harassment
Post by: muddy4x4 on March 19, 2008, 22:23:33
Just wondering if anyone can help me out here ? an adult making a remark to another adult could be referred to as sexual harassment but what if a child made signs referring in a personnel way to an adult. Could this also be sexual harrasment ?

sexual harrassment is just like racist remarks, if the victim deems the remark or action as racist or sexist then it becomes that. If the gesture (sexual) is inapproriate then it is breaking the law, if the gesture is made by a minor then it is dealt with accordingly, I think thats right  :-.

Most issues I can think of are arround "sexual harrasment "are with regard to the workplace so children ar not covered and there would be no real prescident. The obvious exception is schools which I know knothing about, but would expect there is guidence from teaching unions/dfes(or whatever they are called this year).

If its nothing to do with workplace/shcool then its just down to anti-social behaviour or possibly "adult" sex laws (nusance, flashing. assult etc) l if they are a teenager?  Unless its frequent the chances of anyone doing anything are likley to be remote?

How old is the child? If under the age of ten, it woudl be unlikely that any action could be taken. However, if the child is under that age, and is making suggestive comments or actions towards an adult, I would be seriously concerned for the childs welfare. Where did the kid find out about that sort of stuff, considering a lot of things that kids say or do, is learned behaviour.
I'd be making a phone call to Social Services and the Child Protection Unit at the local Police.

Certainly Social Services would want to get involved if the child is under 10, but they may wish to investigate the background circumstances of any child under the age of 16.  Since such behaviour from children towards adults is an indicator that the child may be at risk of some form of abuse.

The child comes first in this situation, being insulted by a minor is not nice, you should report the incident to the Police, so they can compile evidence towards an ASBO / CRASBO, if the insults are of a sexual nature, then report this to the Police, and Social Services, to protect the minor.
