I am having a really bad time at work recently mainly due to my permanent loader being the laziest person ever and anything to get out of doing 3 minutes work he will, yet he will do anything he can to get out of it, like take 5 minutes to roll a fag.
He is one of these young people who seems to think it is ok to spit everywhere as well. I cant prove anything as I didnt see him do it but I have 3 gobs of spit on my car now. It was very fresh when I got in my car as it was still dribblng down the doors and windows.
I have taken photos of it all and 2 swabs on cotton buds. Should I report the incident to the police, or would the police not care or not enough evidence etc? Surely they could prove if it is him or not by the gob on the car?
If anyone knows of ANY job in the Banbury area please let me know. I start with an agency driving class 1 lorries on Monday for Mondays only (I work 4 days a week where I currently am) but I cant take this any longer. I shouldnt want to come home and curl up in a ball and cry each night. My boss says he is working on it to sort the problem out with my loader but he has been working on it for a few months now. I will do near enough any job now, even if it means driving at weekends to get experience up to get a full time job somewhere, but in the mean time stack shelves in tesco for example. I cant remember the last time I was this unhappy in life.

Dude I sympathise totally, what is it with drivers and their loaders? I had a guy back his forklift into my daf and claimed he saw me roll into his forklift. Needless to say this was a while ago now and have since walked.
The only advice I can really offer you is to speak to Citizens Advice and see where you stand legally with collecting evidence etc, Meanwhile I will speak to my boss at work and see if I can get something from an employer point of view.
For Gods Sake "Don't Worry" I know it's very hard to do and now is not the time to walk from a job but your mental health and happiness is worth far more than any job. I have been in the little ball crying situation before so I know where you are coming from.
Keep your chin up and keep a clear head. I will see what I can do for you advice wise from work.

Muddy get your self down to the Doctors as soon as mate.
Tell them how you feel, i went through something similar about 3 yrs ago, and went to see Docs who helped me out of it.
It might not just be your loader where the problem is!!!

hi James, sorry to here of your situation, i have had similar experience myself, do you have a human resources department within your company? if so report it as bullying may sound that your soft but you will get the quickest responce from the HR due to leagal terms now in place. Don't expect instant results as they may ask for the situation to be monitored and the person in question will more than like stop there actions before any disciplinary take place, look on this as job done and not he's got away with it.
If you have reported it to your boss find out what progress he has made, what actions has taken if any, has he spoken with the individual or not. if it has taken some time and no reasonable progress has been made take legal advise from c/advise as your company has responsibility for your welfare if they are neglecting these then you have a strong case to go to tribunal and will most probably win as unlike normal court prove beyond reasonable doubt tribunal you only have to show probability.
try and get a number for a employment law solicitor as well they will be on your side as that is there job a voice for the small person. hope helps you in some way.

sorry to hear about your problem mate, half of me says rise above it and the other half says park the truck on the bonett of whatever vehicle he drives. have you tried just yelling at him for being a lazy scrott?

don't worry is the first thing.
don't let it get to you, why should the scote ruin your home life as well.
either go down the legal route OR the quite word in the back of a van approach. Don't mix as you will end up in trouble.
Where I work a few people have gone to HR, it gets them nowhere. They get branded as moaners through the company. Its not confidential as they will speak to other parties involved who will speak to other employees.
Only accuse him of anything when you have proof. Is there any cctv where you park, if so make sure your car is in view.
If it was me I'd try and turn it round in the way I speak to him and face up to him, without threatening him. Will take time. The odd comment about his lazy ways is a start. Maybe a sly recording on your phone of his fag breaks and spitting. Then ask your manager, in a cheeky way, for the same amount of time off as he has. 6 fags for 5 mins would give you 1/2 hour off a day.
Its hard I know, but its down to you to improve the situation.

Thats vile... If I was not in the job, I would say take hime out side and make the little scrote lick it off!
If it carries on and you boss does nothing call the police, its harressment.

Been wondering whether to reply on this one or not.
If I was your mate and you were complaining at me over a pint at the pub, I'd tell you to grow a backbone and sort it out, not violence, but your a grown man. Most people got over playground bullying when they left school. Flying off the handle at some lazy [!Expletive Deleted!] who thinks he's gods gift in front of a lot of management and other drivers, with carefully thought out examples of time and time again where this bloke has f'd up at a volume loud enough that the management might be able to over hear (and the next town). If the bloke takes a pop at you let him land one. His arse wont hit the ground till the job centre. If there's CCTV in the yard all the better. Remember that under the data protection act, the company has to provide you with a copy anything with data relating to you on - there's a maximum nominal charge of £10.
If you get called into your bosses office, just say that everything you said is true, you were trying to resolve the issue amicably before going down the official route of raising an HR grievance. You can't get a rolliking for doing things in the right order ;)
There will be issues at work for a few days, but keep your head up and you'll feel good about yourself. YOU did the right thing.
I don't know you though, so go down the HR route, and hit your head against a wall whilst nothing happens, you get more depressed, leave the job and end up signing on.

well mate, i know how i would handle it, but not everyone is like me and maybe this :-# thinks you`re an easy target! maybe he could do with a shock to the system, i have seen the quietest people turn around and batter their tormentor after reaching tipping point, never to be abused by the person again. a few mates turning up at the end of a shift might make all the difference...... but thats just my opinion, and as i say, not everyones like me!

well my loader does spit constantly during the day and my car was the only one in the road so it wasnt like it was in a line of cars and I was just unlucky. Also it was still fresh and I wasnt the last lorry back by a long time and the lorry before me has nice guys I get on with on that lorry so very much doubt it was them too.
so I am 99.9% sure it was hime.

it didnt start off to well as I just didnt want to make communication with him at all and the usual stopping at McDonalds to get breakfast 5 minutes into the round happened again too. Then he announced he was going to have a lazy day as he couldnt be ar*** Wasnt impressed. It wasnt until about 1:30pm when he realised just how behind we were that he wanted to get home so he became a totally different person and I actually saw him running occasionally and be a damn good loader. I even said to him, I will buy him a tuck shop full of sweets to keep the sugar intake high if thats what has made him go fast. I also said I have never seen him move like this before and if he moved this fast all the time we may not be the last ones back. I think it all fell on deaf ears though.
So end of the day it wasnt too bad, but I think he has caught wind that I have mentioned the gobbing to a few people and probably wanted to sweaten me up for the weekend so I dont report him.
I have sent a text to a supervisior who also doesnt like him saying I have to talk to him as I am so unhappy and I am so disliked that people are spitting on my car now. Unfortunaley I found out he is on holiday today. Will get hold of him on Tuesday when I return.
So, I'm still not impressed or happy about it but ho hum. I have had confirmation of my driving of artics on Monday which I cant wait to do. :dance: :dance: :dance:

james im sorry you are having probs, too many scrotes about these days , i had a run in with a couple before x,mas,. a bit different , but working on the boats in the summer a young girl died from a blood clot she was a mother of a 1 year old . lovely freindly girl such a sad loss, and then these people like you describe go through life harrassing people and get away with it . i just cant see justice in life sometimes. anyway iff you are unhappy with the situation i would start looking for somewhere else . trust me eventually it will run you down and it aint worth it . hope you get it sorted , chin up summers on its way . are you still doing the boat shows ?. alan

sorry to hear your story, but yes, it does seem to be the nice people get all the grief and nasty people have an easy life.
I have been sending my cv to every company I can think of in my area and looking through job web sites most days.
I will definately be doing the national waterways festival at Beal Park near reading over aug bank hols but not the trail boat festival in Newport this year as I am wanting to go away in the caravan with mates to chill and relax instead.

Hi sorry to hear about your problems,would it not be possible to sit around a table with your manager and your loader,so you can all air your grevances?
Not a slagging match just a controled frank disscusion.
There may be somthing you are hacking him off but at least it would be out in the open and you can draw a line under it and start afresh.
If H.R.or your management will not do anything,it is a good idea to join a union, the transport and gereral workers union should cover you,and talk to the local rep plus you get free legal advice.

James..I hope since this was first posted you have managed to improve the work situation. Personally I know what i would do with the scrote but that is probably not the best response in the modern world.
Maybe his mummy didn't let suck enough titty or his daddy refused to "bath" him, who cares, not your problem and you should not have to deal with this rubbish. All of us go to work to earn money to buy stuff for our land rovers food for our families. No-one should have to tolerate or endure this.
I agree with the posts of those above, do it the right and legal way. If that fails, find a bike shed, take him round the back, and then thump the heck out of the little goit. Perhaps it will do him a big favour and stop him getting into far worse trouble later on or with someone else.

I know there are precious few jobs about at the moment, but if you are driver then your employer should value you more than the monkey who stack boxs in your truck.
If it comes to tit-4-tat though, I've a ton of dog cronk you can liberaly spread on his car/head/lunch in return for the spitting. An endless supply in fact.
He's probably jealous or inadequate, maybe he wanted your job but couldn't pass the test, hardly your fault but some folks have a twisted logic.
Don't just put up with it though, it is harasment and if your employer fails to take action, that's constructive dismissal.

I had a run in with a
monkey driver's "mate" a few years back In his case it was a case of "my normal driver goes faster" "my normal driver reverses better", etc, etc... In the end I told him that if he wasn't happy with the way I drove, to either get a licence and drive the blinking wagon himself, or to sit down, buckle up and shut the heck up. Didn't talk to me more than the strictly necessary for the following 2 days.
Couple of weeks later, I discovered that another driver from my agency had had dealings with the same monkey driver's mate (gee, officer, my subconscious, I swear). In his case, he actually chucked him out of the lorry, somewhere near Reading (lorry based near Dunstable). I was green with envy. Pity it didn't occur to me :twisted:
Just look at it this way: You are working doing what you like, and earning a decent salary, while he is on minimum wage hating you for it. Now tell me who is the miserable git.

all these legal paths do work mate. best thing to do firstly is make people aware you aint yourself. if that means no smiling etc then do it. make people think there is something wrong with you......"i think he is losing it". give them that impression. then see your boss, again. this time hand him a copy of a written letter of whats going on. keep your original copy for evidence.state he has 7days to sort out the problem. if nothing gets done,take in an outside representative(maybe someone with knowledge of the disciplinary system etc). then take your rep in the office with you. then get your boss to pull that @*%!*@ in the office.explain to them you have got no joy in the situation, and its either this way or you will be taking legal action.
other tha that you could go the doctor with stress from work. tell him you wanna kill the guy then put in a nice big claim for bullying and neglect and whatever else they are guilty of.
in the meantime id say nowt to him apart from psychological mind games. like mention that noone has spit on your motor for a while,maybe its cos they have started talking rubbish now.maybe even drive slower.tell him you aint in the modd so you need to concentrate or it could get him injured. lol. there are lots of indirect ways to get him back. good luck

I have spoken to the guy running the agency I went with on Monday. First of all he totally forgot who I was on the phone. Good start!
He didnt realise I drive the bin lorries and got a bit excited when I said "yes for 14-15months now", he could offer me 4days a week at 10 hour shifts which would pay more than I am on at the council and with no grief from loaders and less hours a day than I am currently doing. Being agency would there be that work though? Summer coming so work would pick up. Would he remember I cant do over night runs due to Sandy?
He said it is best for me to go in on Monday and chat to him properly and he can tell me the pro's and cons. Cons being not much work sometimes? as long as it averages out at 4days a week I would be happy.
I did say, "I thought you were sending me out on my own on Monday" to wich he replied "oh, erm, yeah, I dont know what needs covering until friday or saturday" Which is fair enough. I said I would call him on friday to see if I am being sent out on me own or going in for a chat. If it all sounds good then I can walk into the council and handme notice in and good bye muppets! :-)

I blew my fuse at my loader today. Here is what happened.
*what actually happened*
The peak was when we are supposed to take boxes back up a tiny road (5 houses) and he refused to take them so I called my boss to confirm we cant leave them at the end of the road. Boss confirmed. Loaders still refused so I took them back. They then started hooting the horn at me. I got in the cab and 1 guy said cheers ... The next road has a very long reverse so the loaders were in the cab. dead end single track lane. going past a house with a jack russell barking outside and silent in the cab. Then my loader shouts at full volume youwp (trying to be a jack russel barking) but it sounded like ouch. I thought I had hit someone. I then realised it was him. I kept going to the top of the road. On the way back down he did it again. At that point I blew. I slammed the handbrake on. Lorry skidded to a stop, loaders looked shocked, I turned and quietly shouted, "shut up you knob". At that point he started his whole come on then if you want a fight. Lets go out side. I said if he wants to go out side that is fine by me but I wont be getting out myself. I was hoping he would stay there and I could get rid of him! I even pointed to my chin and said "here we are hit it then". He didnt. what a shame.
it did no good what so ever. it just meant he pushed my head about, came within inches of my face telling me if I did it again he would hit me and watch my step out side work as he will hitme. I said go for it. Hitme now if you like. He declined the offer. Every time I look up the road towards him to see where he is, he just shouts back, "what you ... See morelooking at?" Spoken to my boss and he is moving him off my round on Tuesday. I did tell my boss I was going to hand my notice in tomorrow and he said he didnt want me to do that. If the same thing carriers on with new loader then I have to change my attitude the boss said. Lets hope next guy is better. I know he works quick anyway.
He kept saying I know your going to dob me in so phone the boss. Go on then, go on. I said no, lets get the round done and talk to the boss together and sort it like adults. He just declined and said he has a life unlike other people and wants to get home. He rang the boss in the end. My boss called me later to see how much I had left to do and he wasnt that fussed. I spoke to the boss when I got back and he is moving him off my lorry from Tuesday onwards.
I am still going to look for other jobs and I told my boss I was going to hand my notice in tomorrow anyway and he didnt want me to do that or loose me as I am a good worker. Aprently I should have returned back to the office after he refused to take the boxes back as he would have got a disaplinery for it. Damn it!

wish I could say yes, but I dont. I still hate the place and the fact he was saying "what you looking at" to me all afternoon didnt help.
I have never punched anyone but I was so tempted too today, and yes, that would have made me feel good if I had knocked him out! lol
the round he is being moved to is always one of the first rounds to finish and I am always the last. So who has lost out again! muggins! :roll: :doh: :evil:

mate dont worry about it. if your a good worker then your boss knows he can rely on you gettin the job done. and now the idiotis on a different round and finishes before you there is no way he can create trouble for you. also if he was to wait for you outside work then you will have him hook line and sinker. means he would have waited intentionally to get you. just as bad as hitting you at work mate. sack.

Ive only ever had one time like that...little gob [!Expletive Deleted!] that fancied him self as mike Tyson / rocky type person. Riding around on his bike after mouthing off to people all day rode his bike into someone younger than him and then topped it off by pushing him over. The only reason i popped was that i was near to him plus i cannot stand bullies and such like. As soon as the younger kids arse hit the floor i dragged the kid of his bike via his neck onto the floor then grabbed his arm and threw him across the grass and with my knee in his chest we left it at that.... I imagine being dragged out of a wagon would shut him up but then your liable but you do feel so much better for it :lol:

Had the same problem with some of the loaders i use to work with..Actually agency loaders who turn up with a can of coke and a packet of fags for the day thinking they can just sit in the lorry allday..Really use to stress me out doing all there work but i only took it for so long before telling them what i thought..I too got the threats of im going to get you after work my reply yeh when you grow up mate..
