repo of car
« on: December 19, 2005, 19:40:39 »
Well heres a challenge,
Man owes money, say £20k, man he owes it to, gets him to sign over ownership of his car as payment for the £20k, free from any legal encumberment, or outstanding HP.
On collecting car, the Police come around with HP man, saying they want there car back, when told that it was signed over, with signed document saying"free from hp", so possesion 9/10 ths of the law?????????? :?
85% OF ALL LAND ROVERS BUILT, ARE STILL ON THE ROAD,
THE OTHER 15% MADE IT HOME ;)

The Police will tell the HP man to get a court order (They do in any case of disputed ownership), Which they will more than likely get. The inflated costs of which will be added to the HP debt. So everybody but the solicitors loses out from it.

If It was that easy everybody would sign their cars over to their best mates.

i bought a seat ibiza off my brothers so called friend a few years ago ,he said it had no outstanding finance  but when i came to sell it it turned out he had only paid one payment .. i went to the finance company reciept in hand and advert from paper his address and phone number and an innocent face to plead my ignorance and to prove i wasnt scamming .. it took four months to sort it but they were so helpful and removed it of the finance register and also printed me a letter to say the car was now rightly mine ... 1400 quid for a two year old car was well worth the aggro

(but its my phucked old pickup!)

Once the car has gone thro 9 (i think) owners then they can not repo it. That is how all the gipos do it.

Only the HP company's until you have paid 2/3rds then your rights then change, (allegedly)

I'm sure some one say this is wrong!!!

but it is what happended to a mate of mine, they came to repo his car a few weeks ago and he challanged them on it via prior knowledge for CAB and they left the car and rescheduled his payments to what he could afford.

Once 50% has been paid, car can be returned to HP company with no further payments due.
Once 66% has been paid, car cannot be repossed, but is still property of HP company.

It's worth adding that the man with the car has committed fraud too.

Since he has declared something that is untrue in order to profit financially.
