Ive noticed(mainly in the x-eng discussion) that theres a lot of grumbles about the use of the forum.

Yes its an off roading forum etc, but remember guys, the title for this area says:

Surely if someone needs to vent about a feeling/belief/idea, then this si the place for it. Dont slag em for it(you know who you are)
There are plenty of other areas to discuss off road driving arent there, like greenlanes section........

but there comes a point where your opinion and suggestion could land mc into trouble which is not what the admin team need or want.

Thank you Dyf,  now if only people could remember that there is no freedom of speech anymore,  and before people start ranting about that particular fact, I don't like it anymore than you do but we live in a very litigation happy society and that is the be all and end all of the matter.

Although it's called the bar, posting on here is not like a chat in the pub as you can't print out a chat and use it as evidence in a court hearing.

We can all express our opinions, but we just have to be careful what is said and how it is worded.

The USA is full of litigation, and it won't be long until it's here too, everytime the adverts come on TV there is always some sort of Ambulance Chasing solicitor group trying to chase claims for people, but it could easily change from "had a trip or fall that's not your fault" too "read something on the internet that annoys you".

Just be careful chaps (and chapesses), and don't have nightmares  :wink:

ah yes but you need to remember in the bar you dont shout to all the patrons, you talk between a bunch of you

in which the bar on mc differs

if you had a whinge in a pub and someone in that pub didnt like it, then something would be done about it (friendly punch up outside ;) )

but you see what im getting at

Not half.

Interestingly, as far the The Bench is concerned, if something is written and available on a public interweb forum, it is considered in the eyes of the lawto be published; therefore the usual rules regarding defame, libel, tort of ourage etc etc apply.

There's probably a whole host of folk out thar that are unaware of this fact. I certainly was till I chatted it through with a barrister.

Mind you, even in the states 'freedom of speech' is subject to those same caveats anyway!

So, how long before a UK chat forum gets hauled over the coals? Certainly websites already have. Personaly, Ive no idea, but I certainly wouldn't want to be part of the test case..........  :wink:

Happened last year on a football forum I used togo on, club chairman did nt like what had been said, threatened the forum  with serious libel action, the site admin/mod, legal beagles involved both sides letters back and forth ,fund set up to fight the club, went on for weeks ,made the chap ill. Common Sense was seen in the end though.................needless to say the guy does nt run that forum anymore...........

We also have the problem where something gets said and it's not only read/heard by the occupants at the time.
Fred can read something and tell Bill who tells Colin and he then pops in to see what Jim said about him and consider suing.

IF you value Mud Club then don't stick anything out of order on here.

IF you DON'T value Mud Club and it's members then go ahead and put something that's liable to cause offence or Mud Club to be sued.

However don't be surprised if all of a sudden people have their membership revoked. I don't think it has come to that in the past but it wouldn't surprise me in the future.

At the end of the day Mud Club is owned by certain individuals. They all have businesses or property which could be affected by a large court case and the required costs involved.

All that is asked of all of the members is that you/we think of the consequences of what we post and stick to the GUIDELINES. They aren't even rules by anyone's imagination. They are strictly guidelines.

The people here don't seem to realise just what a challenge moderating a forum is. It's not a case of posting a few topics, deleting a few more then giving someone a warning.

Most of the time it's a delicate balance of keeping as many people as possible happy, while still working in the forums best interests.

If anyone here has ever moderated or admin'd a forum then they'll know it's not a simple task, and for a Forum as big as the Mud-Club it's even harder. I've never run a forum with more than 300 members and that was never an easy task, but I enjoyed it.

Personally, I think the Mods/Admins do a great job and should be applauded, and if one or two don't agree then that's the way the world goes, and they shouldn't let that get them down.
