What the...?!! Insurance rip-off?

SOme of you may know, Bunnie was rear-ended while Driving The Rabbit a few weeks back. Its caused her considerable pain from injuries, no end of complications for us and we have ended up with a hire car.


What happened: As she was comming to a stop at a junction, an Alfa Romeoa ploughted into the back of her. I recall it was at traffic lights so he should have been slowing. The Rabbit needs an exhaust and bumper and possibly light clusters. There is NO structural Damage, not one little bit.

So First Letter: 'Its not repairable and will be destroyed'
Uh? NO!. They also want her to sign it off and its my car in my name, she has no right to do this even if she wanted to, wth are they up to. Challenged it and she got a very vague response about not having read the report.

Next Letter, and this is the good one. Informing her that the accident was her fault and she is liable.

Err Hang on

She was Back ended, the proof of this is irrefutable
He admitted responsibility
She was more or less Stationary.

Anyone else smell a rat here?
I must confess the the activities of the UK governments for the past couple of years have been watched with frank admiration and amazement by Lord Vetinari. Outright theft as a policy had never occured to him.

Its the same old story, an insurance company will try anything to get out of paying, no matter who was at fault.  Just keep telling them that its utter crap and to get your car fixed, dont sign it over to them, in fact ask them to have it delivered back to you, if they write it off then you can fix it yourself for not too much money, or use the write off money to buy a new motor and turn rabbit into one of them kit car things :D

We still have the car. And the sitaution stands that if anyone so much as breathes at it I will take them all the way through court. Might go get a wheel clampa nd put  a few rawlbolts in the drive in case.

Threaten them with an enforcement of contract claim at the county court, that usually gets them going as well.  That advice came from a solicitor!
