Speeding Ticket

My dad has got a speeding ticket though the post -  I feel for him, as he cycles nearly everywhere and drives about 500 miles a year - Max. He also never speeds and is normally the one doing 20 mph less than the speed limit.

He was supposedly caught speeding in a 30 last week but there are 2 things id like some help on.

Firstly, he was driving down the road in question an hour after the time on the ticket - so the time is wrong.

Secondly, the surname is spelt wrong on the ticket. As he doesnt really use the car lots, he has never noticed that it is also spelt wrong on the V5.

He is more than prepared to just pay it, but personally i dont think he would be speeding, and the time is wrong.

Worth fighting?

Clock is probobly a GMT thing, possibly a way out with the right lawyer.

Probobly cheaper and easier to pay the fine.

I f you do agree to it, ask if they run a road safety course thingy ( probally not called that) But in short you do a 1 day course on road safety, and shown the error of your ways, You pay the fine but no points    Its a option for him?

In that case the camera has not been caliberated recently, which might help his case.

My dad got a ticket for 64mph in his motorhome in a 40 limit.

I rang the cops and complained, theres no way he would have been speeding at that location. I checked on the type of camera used, its method of operation etc, and asked to see the pictures. We arranged an appointment.
Later the same day, traffic police turned up at Dads house and advised they wouldnt take the matter any further. Large flat sided vehicles such as trucks/motorhomes...(landrovers??)..... cause false triggers. In this case he was doing 32mph........
He was ready to pay and thought he must have actually done it up to this point.

Its worth challenging.

I had a dubious one a couple of years ago;  I remember being overtaken by a motorbike in Slough, and then a couple of months later I got a speeding fine.  I strongly suspect it was the bike that triggered the camera and not me.

However, given the choice of paying a fine, or going to court, I paid the fine.  With hindsight, because of the considerable hassle of sorting out insurance with points on my license, I wish I'd challenged it.  The police ignore the points after 3 years;  the insurance companies don't ignore the points until hell freezes over!

I dissagree with that.....

I had to inform the surers that I'd been naughty and got 3 points and there was no mid term premium increase....

A friend works for a large company, and he says that unofficially 3 points shows you are normal..... now 6 or 9 says trouble and it also depends on what where and when....

I've certainly not been peanalized for 3 points.

In relation to the time aspect, I would think that is a good enough reason to say to question the validity, under the rulings of evidence etc etc.
I would definately ask to see copies of the pics.
I hate those wretched cameras. They are not as perfect as they are made out out to be. More Cops with Radar guns is what is needed.

you cannot be prosucuted for speeding at 2pm if you were not there!
ps. points makes a massive difference on insurance, even more so when you ve been banned for speeding.

More cops out pulling people for driving badly more like it.

The Gov't own figures show how few accidents are caused by speeding.  There are so many other things that need the eye of an officer and can't be caught on camera.

I was advised in a digital tacho training course to not change the tacho in the vans I look after and to keep it to the BST. It was some reason about it being equal to the rest of Europe.

I too wonder about if I got caught and know I wasnt how would I prove it as an hour later / earlier which ever way round it is I may have driven out the village I may have supposidly been speeding through and on a motorway. That may show me doing double the speed limit!

Maybe the camers dont get changed and stay to the same rules as I have just said?

If you challenge the offence and they cannot show the camera was calibrated to the correct time it will be voided. no arguments.

I think now there is a certain time frame that they have to send you the speeding ticket now, I think its 2 weeks :?:

If the time is incorrect I would ask for the photographic evidence as there has been cases of mixed identity

if he can prove he was elsewhere at the time stated on the ticket.... he cannot be found guilty.
I got arrested many hundreds of years ago (happily drunk), i accidentally set off the fire alarm and panic alarm on the way to the cells.... police charged me with criminal damage, but got the time wrong by over an our! The solicitor got the charge thrown out of court due to me being in the pub at the stated time (therefore i couldnt possibly have broke the fire alarm glass).
I popped into the police station after court and gave the desk sarge £20 for the safety glass on the fire alarm (he was impressed & i felt better for rectifying a stupid prank).

that only is an option in wiltshire (correct me if im wrong someone) or in cirtain countys... not possible in for example hampshire.

Yep, Got done for speeding in Wales (35 in a 30 zone) and was offered the chance to take one of those courses! Had to go to all the way back to north Wales to take the course which was known as the 35 mph club, if you were going any faster than that you were not given the chance to attend. A long way to go and it still cost me £60 but at least i got away without any points

In Hampshire they take away your licence, burn your car, seize your house, deport your family, on the principle it will stop you re-offending. Oops, sorry, guess who is a little disgruntled with his employer today?

Digital tachos use UTC (universal time coordinated) - aka GMT - internally although you can set the display time to anything you want. UTC is used throughout Europe irrespective of what local time actually is, which must confuse the hell out of European drivers as mainland Europe is never on GMT  :D  Right now they are on what we call BST and when we go to BST they are on GMT+2  :?
