Cutting a tree down

Friday night I got home and started cutting this tree down about 40ft high (I looked at it and thought it's only a over sized bush) so I got the big ladder climbed up it with the chain saw and started trimmin away about 3 hours later and most of the branches cut off and I'm half way through the trunk a local fake police come up n ask me do I have permition to cut it down I looked at him n said with a stright serious face " do I need permition to cut it down cuz it's only a over grown bush " he went crazy at me saying it's about a hundred year old tree so he goes n I carry on thinkin it's not safe with half the trunk cut so just carry on then the day after I did 4 trips to the tip with the big trailer men at tip were goin nuts as I filled one of there big skips up on my own but they could not stop me as I had permit

My question is will I get told off or what??

You are now apparently supposed to have permission to cut down a tree with a larger diameter at the bas the 12"
DOnt know where to get the opermission from but this is what i have heard.......oh well

The tree were on my land and it were about 24 inch across at the bottom
my way of lookin is I can't pit it back up can I and I have disposed of it by the correct means

Lol up here you can cut down what you want, we took down a tree that was 4ft thick at the end of last year. It was huge. Right beside the main road, church etc and not one complaint.

Dont actually know if it was illegal or not, but like i said nobody was bothered.

depends what type of tree it was, we had a silver birch which we got told afterwards we shouldn't have cut it down.
Bit late when it had gone up in smoke lol.

That's the thing it's too late now it's down n at the tip lol if they ask me to plant another I will do I'll just keep it 3 ft tall n cut it back every few months lol when I set off cuttin it I got the big ladder it's about 30ft long I got to the top of that then went about 10 ft in the tree I them though I wonder how high I am n I looked I were higher than the house then for about the next 10 mins fear were with me I've never ever cut a tree down n I did not dammage anything so I were quite happy with myself lol

I had to google this recently when I was going to winch a neighbours tree down and in short woe-betide if it had a preservation order on it and bare in mind that trees in a conservation area have the same protection as trees protected by a tree preservation order. Landowners need the consent of the council to carry out even the pruning of branches. Statutory maximum fine or twice value of tree fine (how they value a tree I can only guess at) for the cutting down  and up to £20,000 for cutting branches off.
"It's gone now what can I do" is no defence though you can get nabbed 4 years after the fact and as it's supposedly a criminal act it possible to get hauled in for a police interview too before summons. Long as your not living in a conservation area you should be okay nuking your own trees unless there was a restrictive covenant on it or the land but that's a different civil legal matter.

We have a lot of trees in the grounds of our house, and its a conservation area. I have looked into this and the rules are that you must not touch any recognised tree that is over 75mm dia at 1m from the ground without planning permission. Certain types (such as Laurel of which we had some massive examples) are not recognised as trees so you can do what you like to them. Cutting down or heavy pruning of a recognised tree carries a very heavy fine whether its yours or not.

If I were you I would check out if you are in a conservation area, and if so expect big trouble.

Why cart all that timber to a dump? Woodburner users would have taken it away for you.

friend of mine reports to the council for this sort of thing, they have just taken some  bloke to court for downing a tree in his garden that had an order on it, he got fined thousands and has a suspended jail sentence for it, his defence was he had just bought the property and didnt know the tree had an order but apparently all orders and such like are on record with the loacal tree officer at the council and all he had to do was ask they would have told him, house is up for sale again now as bloke cant pay fine

A big no-no i`m afraid [-X, tree preservation orders are taken very seriously by local authority, national heritage organisations etc. You should have checked with the council............. there may be trouble ahead..... :doh:

Oh dear this is not lookin good
I don't live in a conservation area I know that much if I get in troble so be it if they make me sell the house to pay the fine I'll quit work n claim of the state as unable to work because of stress

Its obviously down to the religious leaning of the tree as to how well its protected...

You may be able to get a sneaky peek at the areas where tpo`s are in force, library or council may have the mapping that shows protected trees, if yours was protected then......well.... ....! If not, you`re fine. Just beause you don`t live in a conservation area doesn`t mean the tree didn`t have a tpo, tpo`s are given to the tree, not just the area the tree is in.
 As an example, i recently felled around 10 big old sycamore trees which had no orders on them, next door had an oak about half the size which was protected
 With regards to cutting down a windblown/dangerous tree, you should still check for tpo but if its dangerous or downed then there`s rarely a problem with the authorities allowing it even if it is protected.
 There`s a lesson here methinks

Chances are it will be fine, don't admit to anything. Did the copper take your name or anything? It could have been anyone that chopped that tree down.

The copper knows me as I fitted a bathroom for him a few years ago so  not good I've not heard anything off them yet lol
