Ok this is getting the better of me so thought i would ask you guys. On my TD5 the fold away seats at the back one fits into a recess the other takes up boot space why is this as on other TD5 they both fit into a recess.

What's in the place of the recess on that side then (photo would be good)?

there is no recess for it to fold into

I would say you have rear aircon fitted on your car, if i remeber correct this is where the evaporator sits hence having your seat more inboard on one side.
