Well i dont know if you all remember i was ripped off by a certain breakers a while ago by getting a Disco Engine when i should have got a Defender Engine :twisted:

I was supposed to see them in court on the 16 Dec 05 but they rang to say the owner had bumped his head and could not attend yep right!

anyway were are in court again on the 16Th i hope?

All i want is the extra pennys back i had to fork out for as the engine came stripped and as you know the Disco converstion involves soem work and fabrication so if i was told it was a Defender as i was told then i should not have had to do all this extra work and when you dont work the money does not grown on trees!!

I hope they trurn up or fail to turn up and the Judge may rule in my favour

Just be perpared to have the judge find in your favor, but the scum wont pay up, so you may have to go back to court to get the bailiffs to recover your money.

Your best bet is to sue and have the company closed down.

I am just wondering if they bought time and moved on but i doubt it for little old me, the one thing i do know i found another thread on Tiscally forum when i seached for the breakers to dig some dirt and they did almost exact the same to somone else and he named them as well i submitted this as pre evidence and sent copys to the scum bags as well.

It just means now i have to tell the court the differance between a Defnder Block and Disco Block and fitting ..that should be a laugh 8)

I turned up and went in and sat down and the Judge said the Breakers had sent a fax and they were unable to attend due to unforseen sickness and absence and they were the only people who could run the Breakers and get this one...And if they had to attend they would claim loss of buisness from me!!!!! :twisted:  :twisted:

Anyway the Judge was about to adjorun when i mentioned this was the second time they had no showed and she was not aware..then i was advised to insist on the case being heard in their absence for a second time.

She looked at me and said" You are going to insist are you?"..we both laughed...weird....Then she said i am going to refuse them adjournment and award you £850.00!!!! :shock:  :lol:  :lol: ..

Well chuffed with result and they have 28 days to pay or the Baliffs will collect :(biglaugh):

Shame you had to go to all the hassle in the first place, but 20 Donkey Points are hereby awarded for standing your ground.

......and 20 Donkey droppings are awarded to the breakers....

And as with all court awards that aren't settled on time you have the right to add interest at a reasonable rate. 8% per day is the usual accepected rate and soon mounts up

If it was small claims or magistrates most judges are sympathetic when they know folk have been ripped off. They are there to act fairly in most instances, it's only when you try to pull the wool over their eyes that they go into silly mode

ya right the Laws should be better they can set up and trade else ware..
I contacted the Fair trading and they were well aware of them and and investigating ..

Also when i did a search on the Scum i found a thread on Tiscally were another bloke was ripped the same way with em..and the pattern works this way they say they have the parts and they dont ..they take your money and then get on the blower and source the parts elseware!!

They then take the Cream off the Top

Just like to say thanks for all ya thanks  :lol:

This has made me sick to guts i have had to wait for this since August since attempting to fit the Disco block.. even the misses had a hand in it she was the one who held to hoist to keep the Block from comming off the Gearbox so i could get firts two Bolts on Bellhousing..Neigbours must of thought we were mad!!

Then as it was stripped i had to buy one bit when i could afford it and then fit it then wait weeks till i could afford another part and fit that!!
At least i know my way round my Engine now and Disco converstion... 8)
